Breathalyzers have been developed for the purpose of administering roadside or laboratory tests that can detect the actual level of a controlled substance in an individual’s body. People who have alcohol use disorder (AUD) can benefit from long-term, tailored, and specialized treatment programs. Ideally people would receive treatment for AUD before committing an alcohol-impaired driving offense. However, when people are arrested for alcohol-impaired driving, this can serve as an opportunity to assess drinking habits and refer them for brief interventions (described below) or specialized treatment. Treatment for people with AUD who are convicted of alcohol-impaired driving is most effective when combined with other strategies (such as ignition interlocks) and when offenders are closely monitored.

Penalties should include a combination of administrative sanctions (e.g. driving licence suspension) and criminal ones (e.g. mandatory minimum fines) of adequate severity. The Preliminary Breath Test (PBT) or Preliminary Alcohol Screening test (PAS) is sometimes categorized as part of field sobriety testing, although it is not part of the series of performance tests. Commercial drivers are subject to PBT testing in some US states as a “drug screening” requirement. They have called on a sometimes slow-moving NHTSA to address a backlog of traffic safety regulations ordered by Congress nearly a decade ago, such as mandatory rear seat belt reminders. The department recently said it will release a “safe system approach” to road safety in January that identifies safety action for drivers, roads, vehicles, speeds and post-crash medical care. BAC limits are most effective when enforcement is consistent and highly visible, when detection of violation results in penalties that are certain, swift and sufficiently severe, and when supported by effective public education campaigns.

Mothers against Drunk Driving (MADD) is the nation’s largest nonprofit working to protect families from impaired driving and underage drinking. In the United States, the NHTSA finds that alcohol-impaired driving accounts for 28% of all traffic-related deaths. According to the NHTSA, in 2021, the highest percentage of drunk drivers with BACs of .08 or more were in the age range of 21 to 34, with four male drunk drivers for every female drunk driver.
